Bannister Law –Affected Nurofen Specific Pain Relief Products – Class Action

Bannister Law is calling for consumers who acquired the above Nurofen products to register on the website. The purpose of registration is to seek compensation for consumers who bought the above products and a suffered financial loss.

Reckitt Benckiser Australia, the marketers and distributors of Nurofen Pain Relief Products in Australia have been found by the Federal Court to have misled and deceived consumers in relation to selling and marketing products within the Nurofen Specific Pain Range Nurofen case link.

The products marketed in a manner found to be misleading and deceptive were:

  1. Nurofen Migraine Pain ibuprofen lysine 342 mg tablet blister pack;
  2. Nurofen Tension Headache ibuprofen lysine 342 mg tablet blister pack;
  3. Nurofen Period Pain ibuprofen lysine 342 mg tablet blister pack;
  4. Nurofen Back Pain ibuprofen lysine 342 mg tablet blister pack.

Reckitt Benckiser’s conduct was found to be misleading the public as to the nature, characteristics and suitability of purpose for the Nurofen specific pain products.  Reckitt Benckiser were found to have made representations that the products were specifically formulated to treat migraine, tension headache, back pain and period pain. However, each product contained the same active ingredient.

We are investigating the claim as being the price differential between the lower priced ordinary Nurofen products, and other products containing ibuprofen (the active ingredient); and the higher priced, Nurofen specific pain product range (shown in the photograph above) that the consumer may have purchased in the belief that they had to pay more money to receive pain relief. Based on the ACCC proceedings, we are investigating whether consumers were misled into buying more expensive products instead of less expensive products in the Nurofen range or other ibuprofen products.

If instructed to commence proceedings, Bannister Law will request that the court order a proportion of the compensation be paid to affected consumers and a proportion be payable to an appropriate charity, subject to the approval of the court. Bannister law fights for the rights of individuals who don’t have the resources to fight against large corporations and to give access to justice.
